1. Agreement to Terms

By accessing and using the services of Capital Synergy Campervan Rentals ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Services

Capital Synergy Campervan Rentals provides campervan and motorhome rental services throughout Australia. Our services include:

  • Vehicle rental and booking services
  • Customer support and roadside assistance
  • Travel planning and destination advice
  • Equipment and accessory rentals

3. Eligibility Requirements

To rent a vehicle from us, you must:

  • Be at least 21 years of age (25 for luxury vehicles)
  • Hold a valid driver's license for at least 2 years
  • Provide a valid credit card for security deposit
  • Meet our insurance requirements
  • Provide accurate identification documents

4. Booking and Payment Terms

4.1 Reservations

All reservations are subject to vehicle availability. A booking is confirmed only upon receipt of full payment or approved deposit.

4.2 Payment

  • Full payment is required at the time of booking for rentals under 7 days
  • 50% deposit required for rentals over 7 days, with balance due 14 days before pickup
  • Security deposit of $1,000-$3,000 (depending on vehicle) via credit card authorization
  • All prices are in Australian Dollars (AUD) and include GST

4.3 Cancellation Policy

  • Free cancellation up to 48 hours before pickup
  • Cancellations within 48 hours: 50% of rental fee retained
  • No-shows: 100% of rental fee retained
  • Weather-related cancellations may be eligible for full refund

5. Vehicle Use and Restrictions

5.1 Permitted Use

Vehicles must be used for lawful purposes only. You agree to:

  • Drive safely and obey all traffic laws
  • Use the vehicle only for personal, non-commercial purposes
  • Maintain the vehicle in good condition during rental
  • Report any incidents or damage immediately

5.2 Prohibited Activities

The following activities are strictly prohibited:

  • Driving under the influence of alcohol or drugs
  • Off-road driving or beach driving
  • Smoking inside the vehicle
  • Transportation of pets without prior approval
  • Exceeding maximum occupancy limits
  • Using the vehicle for racing or commercial purposes
  • Driving in prohibited areas (Cape York, remote mining areas)

6. Insurance and Liability

6.1 Insurance Coverage

All rentals include comprehensive insurance with:

  • Third-party liability coverage
  • Collision damage waiver (excess applies)
  • Theft protection
  • 24/7 roadside assistance

6.2 Excess and Liability

  • Standard excess: $2,500 for compact, $3,500 for family, $5,000 for luxury
  • Excess reduction options available for additional fee
  • You are liable for damages not covered by insurance
  • Personal belongings are not covered by our insurance

7. Vehicle Condition and Return

7.1 Pre-Rental Inspection

A thorough vehicle inspection will be conducted before handover. Any existing damage will be documented and acknowledged by both parties.

7.2 Return Requirements

Vehicles must be returned:

  • At the agreed time and location
  • In the same condition as received (normal wear excepted)
  • With fuel tank at same level as pickup
  • Clean and free of personal belongings
  • With all provided equipment and accessories

7.3 Late Returns

Late returns may incur additional charges of $50 per hour. Returns more than 24 hours late will be charged for an additional full day.

8. Damage and Repairs

In case of accident or breakdown:

  • Contact emergency services if required
  • Notify us immediately (within 24 hours)
  • Obtain police report for accidents
  • Do not attempt repairs without authorization
  • Cooperate fully with insurance investigations

9. Personal Property

We are not responsible for personal property left in vehicles. Items left behind will be held for 30 days, after which they may be disposed of. Storage and return shipping fees apply.

10. Limitation of Liability

Our liability is limited to the maximum extent permitted by law. We are not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of use, profits, or business opportunities
  • Personal injury not caused by our negligence
  • Delays due to weather, traffic, or mechanical issues

11. Force Majeure

We are not liable for failure to perform due to circumstances beyond our reasonable control, including natural disasters, government actions, or public health emergencies.

12. Privacy and Data Protection

Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your personal data.

13. Modification of Terms

We reserve the right to modify these Terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services constitutes acceptance of modified Terms.

14. Dispute Resolution

Any disputes arising from these Terms or our services shall be resolved through:

  1. Good faith negotiation
  2. Mediation if negotiation fails
  3. Binding arbitration under Australian Commercial Arbitration Rules

15. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any legal proceedings must be brought in the courts of Victoria.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
